Dormancy Periods

The dormancy period is how long property must be inactive before it is considered unclaimed and reported to the state.

Maine adopted a RUUPA-based act effective October 1, 2019, replacing the prior Uniform Unclaimed Property Act (Title 33, Ch. 41). Reporting deadline is October 31 for most holders; April 30 for life insurance companies. State holds property indefinitely until claimed by owners or heirs. In FY2024, the Treasurer's Office processed over 68,000 claims.

Finder / Helper Restrictions

Restriction Level: Moderate

Fee Cap: 15% — Agreements made more than 24 months but less than 36 months after delivery to the administrator may not charge fees exceeding 15% of the value of the property recovered. Agreements made during the first 24 months after delivery are void and unenforceable. Agreements providing unconscionable compensation are unenforceable (33 M.R.S. section 2201).

Waiting Period: 24 months — An agreement to locate, deliver, recover, or assist in recovery of unclaimed property is void and unenforceable if entered into during the period beginning on the date the property was presumed abandoned and extending to 24 months after the date the property is paid or delivered to the administrator (33 M.R.S. section 2201).

Solicitation Rules: No specific solicitation restrictions in statute beyond the waiting period and fee cap requirements.
