Dormancy Periods

The dormancy period is how long property must be inactive before it is considered unclaimed and reported to the state.

Utah adopted the 2016 Revised Uniform Unclaimed Property Act (RUUPA) in 2017, becoming the second state to enact it (SB 175, signed by Governor Herbert on March 24, 2017). Most property types have a uniform 3-year dormancy period. Wages and commissions are 1 year. Annual reporting deadline: November 1. Record $128M turned over to state in FY2024. Division returned record $43.4M in FY2025, processing 29,254 claims.

Finder / Helper Restrictions

Restriction Level: Strict

Fee Cap: 20% — Finders may charge up to 20% of the recovered property value. However, the power of attorney submitted with the claim CANNOT contain any contractual provisions such as fee or percentage charged.

Waiting Period: 24 months — Finders must wait 24 months after the delivery of any property to the Unclaimed Property Division before any agreement they make to recover or assist in the recovery of that property is valid.

Solicitation Rules: No specific solicitation timing restrictions beyond the 24-month waiting period. Power of attorney must be original (copies not accepted) and must not contain any fee or contractual provisions.
